HIV is not a crime. However, in more than half of the US states and over 92 countries, HIV non-disclosure, exposure, and transmission are criminalized through law. These laws first showed up in 1986 during peak hysteria surrounding the virus as a result of federal funding that incentivized
US states to criminalize the spreading of HIV.
Intended to protect people from HIV, these laws actually just fueled stigma by discouraging people from getting tested and seeking treatment. These laws can also encourage and perpetuate domestic violence as victims of abusive relationships may be scared to leave abusive relationships with the threat of an HIV criminalization charge.
These laws are not only misaligned with the justice system but they ignore the truth about HIV. The best way to fight is together. Let’s unite to break down barriers keeping people from knowing their true HIV status.
